The 2026 Texas Inspection Reality
As of January 1, 2025, House Bill 3297 officially eliminated the annual safety inspection for non-commercial vehicles in Texas. However, this does not mean the inspection process has disappeared for Austin drivers.
- Emissions are Still Mandatory: Because Austin is located in an emissions-priority zone, gasoline-powered vehicles (aged 2–24 years) registered in Travis and Williamson Counties must still pass an annual emissions test to renew their registration.
- The Replacement Fee: The state has maintained the $7.50 fee under a new name: the Inspection Program Replacement Fee, which is collected at the time of your registration renewal.
- Obstructed View Laws: It remains a misdemeanor to operate a vehicle with any object or material on the windshield that obstructs or reduces the driver’s clear view.

Your Legal Right to OEM Glass (SB 1429)
A major victory for Texas consumers, Senate Bill 1429, went into effect for insurance policies issued or renewed on or after January 1, 2026. This law specifically addresses the quality of parts used in your repairs.
If your vehicle is 36 months old or newer, your insurance provider is now generally required to authorize OEM parts and follow the manufacturer’s specific repair processes. Insurers are prohibited from “steering” you to a specific shop and cannot force you to use generic, cheap glass.
